Guidance for the Community in Sukatani Village, Compreng District, Subang Regency, Regarding the Validity of Divorces Not Filed in Court

Abstract

This research is motivated by the social understanding of divorces that are not filed in court. From a social perspective, the validity of a divorce that is not brought to court is considered legitimate. As happened in the community of Sukatani Village, Compreng District, Subang Regency. However, according to the law and the Compilation of Islamic Law, that is not valid. This research aims to determine the public's attitude and the impact of divorces not filed in court by the residents of Sukatani Village, Compreng District, Subang Regency, until the provision of guidance on divorce regulations not filed in court. This research uses the mentoring method (personal approach and community approach), a qualitative method using a literature study approach (library research) by examining topics found in books, journals, and factual news related to the research and conducting content analysis and interviews. The research results show that, in essence, divorces not filed in court in Sukatani Village, Compreng District, are considered valid because they are unaware of the rules, do not want to go to court, do not want the risk of costs, and are afraid of going to court. This is due to their lack of knowledge about the legal rules of divorce. This research recommends that the impacts of divorce not filed in court are the legitimacy of the divorce, custody, inheritance, and administrative difficulties.
